State Futures’ New Report Highlights State-Led Strategies to Limit Federal Cooperation, Increase Transparency, and Enforce Appropriate Standards in Detention Facilities
Washington, DC — April 3 – State Futures today released a new Issue Brief highlighting the surge of state-level action addressing detention centers. This comprehensive new issue brief details the many state-led actions designed to limit federal cooperation, enforce rigorous safety standards, and establish enforceable protections for detained individuals. From California to Virginia, states are deploying a full arsenal of legislative, legal, and oversight tools to hold detention centers accountable.
“As the federal government expands its use of immigration detention, state legislators are stepping forward to exercise their oversight authority and protect the rights of people in their communities,” said Gaby Goldstein, President of State Futures.
“State legislators are not limited to reacting to federal policy,” Goldstein added. “They are actively shaping conditions on the ground - including through health and safety standards, reporting requirements, facility inspections, and public engagement that makes detention practices visible and accountable.”
Key Trends in State Action:The issue brief identifies several major areas where state legislators are advancing oversight of immigration detention facilities, including:
Restricting discretionary cooperation between state and local agencies and federal immigration detention enforcement
Establishing health and safety standards for detention facilities through state public health authority
Expanding inspection authority to ensure access to facilities and oversight of detention conditions
Regulating private detention facilities through zoning, permitting, and proposed taxation frameworks
